1. Agreement to Terms

By accessing or using CallJack ("Service"), operated by LeadLock LLC ("Company," "we," "us"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

2. Description of Service

CallJack is an AI-powered missed call capture and lead engagement platform for contractors and home service businesses. The Service automatically sends SMS messages to callers who reach a contractor's phone number and are not answered, enabling AI-driven lead qualification and follow-up on behalf of the contractor.

3. SMS Messaging Program — Terms

Program Name: CallJack AI Lead Response

Program Description: Automated SMS messages sent to individuals who call a CallJack-enabled contractor phone number. Messages are sent to qualify the lead and facilitate a callback from the contractor.

• Message Frequency: Varies. Typically 1–10 messages per lead inquiry depending on conversation activity.
• Message & Data Rates: Standard message and data rates may apply. Contact your mobile carrier for details.
• Opt-Out: Reply STOP to any message to unsubscribe. You will receive one confirmation message and no further messages will be sent.
• Help: Reply HELP to any message for assistance, or contact [email protected].
• Supported Carriers: All major US carriers. Carrier support may vary.

4. Contractor Accounts

Contractors who register for a CallJack account ("Subscribers") are responsible for:

• Providing accurate business information during onboarding
• Maintaining the security of their account credentials
• Ensuring their use of the Service complies with applicable laws, including the TCPA (Telephone Consumer Protection Act) and CAN-SPAM Act
• All SMS communications sent through the Service on their behalf
• Configuring their phone forwarding and Twilio settings correctly

5. Subscription & Billing

• CallJack is offered at $297/month per account, billed monthly via Stripe.
• New subscribers receive a 14-day free trial. A valid credit card is required to start the trial.
• If not cancelled before the trial ends, your card will be charged $297 on day 15.
• Subscriptions renew automatically each month until cancelled.
• You may cancel at any time from your Billing dashboard. Cancellation takes effect at the end of the current billing period.
• We offer a 30-day money-back guarantee for new subscribers. Contact [email protected] within 30 days of your first charge to request a refund.

6. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited commercial messages, or messages unrelated to the caller's inquiry
• Violate any applicable federal, state, or local laws or regulations
• Impersonate any person or entity
• Transmit any content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
• Interfere with or disrupt the integrity or performance of the Service

7. Intellectual Property

The Service and its original content, features, and functionality are owned by LeadLock LLC and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee that AI-generated messages will result in lead conversion or revenue generation.

9. Limitation of Liability

To the maximum extent permitted by law, LeadLock LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid us in the 30 days preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Sacramento County, California.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.
